Bellevue City is enforcing Ordinance 6233 after a recent ruling that a whole house short-term rental on VRBO, AirBnB and similar counts as a Rooming House, which is prohibited in Single Family zones. Bellevue City has worked on over a hundred cases in the last 18 months.
The topic of AirBnB (whole house short term rentals) in Surrey Downs has been mentioned several times and so I attended a recent City Planning Commission meeting to learn more. A recent City Council “interpretation” of code (see http://www.bellevuewa.gov/pdf/Land%20Use/16-141664-DA.pdf ), the section that applies is referred to as Rooming Houses, clarified that Rooming Houses (including AirBnb short-term rentals) are not allowed in Single Family zoned areas. The Ordinance was adopted in April 2015. Owner-occupied room rentals as well as Bed and Breakfast are allowed with the right permits and business licences.
Enforcement provisions proscribe the steps to undertake enforcement, starting with education and information through fines of $100-$500 a day. The City will shortly start publishing enforcement information. Lake Hills and Crossroads are the main areas (adverts can easily be found on the websites). Cases with multiple calls / complainants are prioritized.
